1. Acceptance of Terms

By accessing or using the services of Tennis Court Builders of Dallas ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Description

Tennis Court Builders of Dallas provides tennis court construction, resurfacing, drainage solutions, lighting installation, fencing, and maintenance services. All services are subject to availability and may be modified or discontinued at any time without notice.

3. Quotes and Estimates

All quotes and estimates provided by Tennis Court Builders of Dallas are valid for 30 days unless otherwise specified in writing. Estimates are based on information available at the time of assessment and may be subject to change based on site conditions, material costs, or scope modifications.

Final pricing will be determined upon completion of a detailed site evaluation and documented in a written contract signed by both parties.

4. Payment Terms

Payment terms are as specified in your individual service contract. Generally, we require:

  • A deposit upon contract execution to secure project scheduling
  • Progress payments as specified in the contract
  • Final payment upon substantial completion of the project

We accept payment by check, credit card, or electronic transfer. Late payments may be subject to interest charges as permitted by law.

5. Project Timeline

Project timelines provided are estimates based on normal working conditions. Delays may occur due to weather, material availability, permitting processes, or other circumstances beyond our control. We will communicate any significant delays as soon as they are identified.

6. Warranties

Tennis Court Builders of Dallas provides workmanship warranties as specified in individual contracts. Material warranties are provided by manufacturers and vary by product. Warranty claims must be submitted in writing and will be addressed promptly.

Warranties do not cover damage caused by:

  • Improper use or abuse of the facility
  • Failure to perform recommended maintenance
  • Acts of nature (floods, earthquakes, severe storms)
  • Unauthorized modifications or repairs
  • Normal wear and tear

7. Site Access and Preparation

The client is responsible for:

  • Providing clear access to the work site
  • Marking underground utilities before construction begins
  • Obtaining necessary permits unless otherwise agreed in writing
  • Removing obstacles and vegetation as specified in the contract
  • Ensuring pets and children remain away from the construction area

8. Changes and Modifications

Any changes to the scope of work must be requested in writing and will be documented through a change order. Work on changes will not begin until the change order is signed by both parties. Changes may affect project timeline and final cost.

9. Limitation of Liability

Tennis Court Builders of Dallas liability is limited to the amount paid for services rendered. We are not liable for indirect, incidental, consequential, or punitive damages. Our total liability shall not exceed the contract price for the specific services giving rise to the claim.

10. Indemnification

Client agrees to indemnify and hold harmless Tennis Court Builders of Dallas, its employees, contractors, and agents from any claims, damages, or expenses arising from:

  • Client's breach of these Terms
  • Client's negligence or willful misconduct
  • Client's failure to comply with applicable laws or regulations
  • Any claims related to pre-existing site conditions not disclosed to Tennis Court Builders of Dallas

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Dallas County, Texas.

12. Cancellation Policy

Either party may cancel a project with written notice. If cancellation occurs after work has begun or materials have been ordered, the client is responsible for payment for work completed and materials purchased up to the cancellation date, plus any restocking fees charged by suppliers.

13. Force Majeure

Neither party shall be liable for failure to perform due to causes beyond their reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, government actions, or extreme weather conditions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
